These Terms and Conditions (“Terms”) govern your access to and use of https://migrainebodyreset.com/ (the “Website”) and the digital products, online courses, videos, educational programs, live sessions, coaching services, exercises, materials, and other services offered through or in connection with the Website (collectively, the “Services”).
The Website and Services are operated by Bluma Properties, LLC, a Wyoming limited liability company, doing business as Migraine Natural Solution and operating the Migraine Body Reset brand (“Company,” “we,” “us,” or “our”).
Please read these Terms carefully before purchasing or using the Services.

1. Acceptance of These Terms
By purchasing a Service, creating an account, clicking a button or checkbox indicating acceptance of these Terms, or otherwise accessing or using the Services after being presented with these Terms, you agree to be bound by them.
If you do not agree to these Terms, you should not purchase or use the Services.
Any product-specific terms, prices, access periods, refund guarantees, or other material conditions presented on the applicable sales page or at checkout form part of your agreement with us for that particular purchase.
If a product-specific term expressly conflicts with these Terms, the product-specific term will control with respect to that particular purchase.

2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use the Services.
By purchasing or using the Services, you represent that you meet these requirements.
The Services are intended primarily for personal, individual use unless we expressly provide a separate business, professional, group, or institutional license.

3. Accounts and Account Security
Certain Services may require you to create an account.
You agree to provide accurate and current information and to update that information when reasonably necessary.
You are responsible for maintaining the confidentiality of your username, password, and other login credentials and for activity occurring through your account to the extent reasonably within your control.
Unless we expressly authorize otherwise:
each account is for one individual user;
you may not share your login credentials;
you may not allow other persons to access paid content through your account;
you may not sell, transfer, assign, or sublicense your account or course access.
You must promptly contact us at info@migrainebodyreset.com if you reasonably believe that your account has been accessed without authorization.

4. Nature of the Services
The Services provide educational and wellness content that may include:
breathing practices;
gentle movement;
stretching and mobility exercises;
yoga-inspired practices;
relaxation techniques;
body-awareness practices;
self-massage techniques;
educational information concerning tension, headaches, and migraine-related experiences;
prerecorded digital courses and videos;
downloadable educational materials;
live group sessions;
one-to-one sessions;
wellness coaching;
personalized feedback; and
individualized suggestions concerning exercises or wellness practices.
The specific features included in a particular Service will be described on the applicable sales page, checkout page, or course description.

5. Educational and Informational Purposes Only
THE SERVICES ARE PROVIDED FOR GENERAL EDUCATIONAL, INFORMATIONAL, AND WELLNESS PURPOSES ONLY. THEY ARE NOT MEDICAL SERVICES AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL CARE.
Neither the Company nor its instructors, coaches, employees, contractors, or representatives, when providing the Services:
provides medical advice;
diagnoses medical conditions;
provides medical treatment;
prescribes medication;
provides psychotherapy or other licensed healthcare services;
represents that the Services cure, treat, diagnose, or prevent any disease or medical condition; or
provides emergency medical services.
Information provided through the Services should not be interpreted as a medical diagnosis, medical recommendation, or individualized medical treatment plan.

6. No Healthcare-Provider Relationship
Your use or purchase of the Services does not create a doctor-patient, therapist-patient, physical-therapist-patient, or other licensed healthcare-provider relationship between you and the Company, an instructor, a coach, or any other person associated with the Services.
This remains true when a Service includes one-to-one sessions, personalized feedback, individualized exercise suggestions, or discussion of information you voluntarily provide about your experiences or symptoms.
Any individualized suggestions are provided solely as educational or wellness guidance and are not based on a comprehensive medical assessment.
Even if an instructor or contributor separately holds a professional or healthcare qualification, that person is not acting as your healthcare provider through the Services unless a separate written agreement expressly states otherwise.

7. Consult Qualified Healthcare Professionals
You should consult an appropriately qualified physician or other healthcare professional regarding:
migraine or recurring headaches;
persistent, severe, new, or changing symptoms;
injuries or medical conditions;
pregnancy or other conditions that may affect physical activity;
medications;
changes to a treatment plan; and
whether a particular exercise or wellness practice is appropriate for you.
DO NOT DISREGARD, DELAY, OR REPLACE PROFESSIONAL MEDICAL ADVICE BECAUSE OF INFORMATION PROVIDED THROUGH THE SERVICES.
You should not stop, reduce, replace, or otherwise change prescribed medication or medical treatment based on information provided through the Services without consulting an appropriately qualified healthcare professional.
The Services are intended to complement, not replace, appropriate professional care.

8. Emergencies and Potentially Serious Symptoms
The Website and Services are not intended for use in medical emergencies.
If you believe that you are experiencing a medical emergency or potentially serious symptoms, do not rely on the Website, courses, exercises, email communications, support messages, live sessions, or other Company content.
Seek appropriate medical assistance promptly. In the United States, this may include calling 911 where appropriate.
Company email addresses and support channels are not monitored or intended as emergency medical services.

9. Physical Activity, Self-Massage, and Exercise Safety
Movement, stretching, mobility practices, yoga-inspired exercises, breathing exercises, self-massage, and other physical activities involve inherent risks.
You are responsible for determining whether an exercise or practice is appropriate for you based on your circumstances and any professional advice you have received.
You should not perform an exercise or practice if you have been advised by an appropriately qualified healthcare professional not to do so.
Perform movements gently and within your own comfortable range. Do not force a movement or continue a practice simply because it appears in a course, video, or live session.
STOP AN EXERCISE OR PRACTICE IMMEDIATELY IF YOU EXPERIENCE PAIN, DIZZINESS, FAINTNESS, UNUSUAL SHORTNESS OF BREATH, WORSENING SYMPTOMS, UNUSUAL SYMPTOMS, OR ANOTHER ADVERSE REACTION.
Seek appropriate professional care when necessary.
To the maximum extent permitted by applicable law, you voluntarily assume the ordinary and inherent risks associated with your voluntary participation in physical wellness activities provided through the Services.

10. Live Sessions, Coaching, and Personalized Guidance
Certain Services may include live group sessions, one-to-one calls, coaching, personalized feedback, or individualized suggestions.
These features remain educational and wellness-oriented even when the instructor takes into account information that you voluntarily provide.
The Company and its instructors do not independently verify your medical history and do not perform medical examinations, diagnostic evaluations, or clinical assessments.
You remain responsible for:
deciding whether to participate in a particular activity;
communicating any relevant physical limitations that you choose to disclose;
following advice provided by your healthcare professionals;
stopping an activity when appropriate; and
seeking professional medical care when needed.
Personalized educational guidance should not be interpreted as medical diagnosis or treatment.

11. No Guarantee of Health or Other Results
Individual experiences vary.
We do not guarantee that a course, exercise, self-massage technique, breathing practice, coaching session, or other Service will:
prevent migraine or headaches;
reduce their frequency, duration, or intensity;
relieve pain or tension;
prevent future symptoms;
reduce the need for medication;
improve a medical condition; or
produce any particular physical, health, wellness, financial, or other result.
Testimonials, success stories, personal experiences, and examples describe individual experiences and do not guarantee that you will obtain the same or similar results.

12. Course Access
Unless a particular sales page or checkout page expressly provides a longer access period, a one-time purchase of an online course provides access for as long as the applicable Service continues to be made available by the Company and, in any event, for no less than two (2) years from the date of purchase.
This minimum access period does not apply if:
you receive a refund for the applicable purchase;
your access is terminated because of a material violation of these Terms;
continued access would violate applicable law; or
another product-specific agreement expressly provides otherwise.
If we permanently discontinue a purchased course before the end of the two-year minimum access period for reasons unrelated to your conduct, we will use commercially reasonable efforts to provide substantially equivalent alternative access. If we cannot reasonably do so, we will provide an appropriate refund or credit based on the remaining portion of the guaranteed access period, subject to applicable law.
Course access may depend on third-party hosting platforms, internet connectivity, and compatible devices or software.

13. Changes to Courses and Services
We may periodically update the Services to:
improve content;
correct errors;
update course organization;
replace or update videos;
change hosting technology;
improve security;
add or remove supporting materials; or
make other reasonable operational changes.
We may also change instructors or presentation formats where reasonably necessary.
We will not intentionally modify a purchased Service in a manner that materially deprives you of the core content you purchased during a guaranteed access period without providing an appropriate alternative or remedy where required.

14. Personal License
When you purchase a digital product or Service, you are purchasing access to the content, not ownership of the underlying intellectual property.
Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the applicable materials for your own personal, noncommercial educational purposes during the applicable access period.
All rights not expressly granted to you remain reserved by the Company or the applicable rights holder.

15. Intellectual Property
The Website and Services may contain:
videos;
audio recordings;
written materials;
course lessons;
exercise sequences;
graphics;
photographs;
illustrations;
worksheets;
downloadable materials;
logos;
trade names;
trademarks;
branding;
website content; and
other proprietary materials.
These materials are owned by or licensed to the Company and may be protected by copyright, trademark, and other applicable intellectual-property laws.
Except where expressly authorized by us or permitted by applicable law, you may not:
copy or reproduce paid course materials;
make screen recordings of paid materials;
make unauthorized audio or video recordings of course content;
photograph or capture substantial portions of paid content for redistribution;
download materials that are not expressly provided for download;
upload or repost materials on websites, social media, cloud-storage services, file-sharing services, or other platforms;
distribute materials to another person;
share your account or course access;
sell, rent, sublicense, or commercially exploit our materials;
use our materials to create a copied or substantially derivative commercial course or competing product;
remove copyright, trademark, or proprietary notices;
bypass technological access restrictions;
scrape or systematically extract protected course content;
reverse engineer technological components except where applicable law expressly permits it; or
otherwise use the Services in violation of our intellectual-property rights.
Nothing in these Terms prohibits lawful criticism, commentary, consumer reviews, or other uses protected by applicable law.

16. Prohibited Conduct
You may not use the Website or Services to:
violate applicable law;
commit or facilitate fraud;
gain unauthorized access to accounts, systems, or data;
interfere with the operation or security of the Website;
introduce malicious software;
manipulate Website data;
impersonate another person;
circumvent access controls;
make unauthorized copies of protected content;
resell or redistribute access;
use automated tools to scrape substantial protected content; or
otherwise materially interfere with the rights of the Company, other users, or third parties.

17. Orders and Payment
The price and material purchase terms applicable to a Service will be displayed before you complete your purchase.
Unless otherwise stated, payment is due at the time of purchase.
All online courses currently offered by the Company are sold as one-time purchases and do not automatically renew.
We may change prices for future purchases. A future price change does not retroactively change the price of a completed purchase.
Applicable sales, use, or similar taxes may be collected where required by law.
If your bank, card issuer, or payment provider applies currency-conversion charges, foreign-transaction fees, or other charges, those charges are determined by that provider unless expressly stated otherwise during checkout.

18. Order Errors, Fraud, and Cancellation by the Company
We may reject or cancel an order where reasonably necessary because of:
suspected fraud;
unauthorized payment;
an obvious pricing or technical error;
violation of these Terms;
legal or regulatory requirements; or
inability to provide the purchased Service.
If we cancel an order after collecting payment but before providing the applicable Service, we will refund the amount collected, except where applicable law permits otherwise.

19. Payment Processors
Payments may be processed using independent third-party payment processors.
Those providers may apply their own terms, privacy policies, security procedures, and authentication requirements.
We do not control the operation or availability of independent payment-processing systems.
Information regarding the personal and payment data that we and our service providers collect or process is addressed separately in our Privacy Policy.

20. Refund Guarantee
Certain Services are offered with either a 14-day or 30-day money-back guarantee, depending on the specific product.
The applicable guarantee period will be clearly identified on the relevant sales page, offer, or checkout page.
Unless a particular offer expressly states otherwise, the guarantee period begins on the date of purchase.
During the applicable 14-day or 30-day guarantee period, you may request a refund for any reason by contacting:
info@migrainebodyreset.com
You are not required to demonstrate that you completed the course or satisfy a minimum-use requirement in order to qualify for the applicable guarantee.
Approved refunds will generally be returned through the original payment method where reasonably possible.
Once a full refund has been issued, your access to the refunded Service may be terminated.
Outside the applicable money-back guarantee period, purchases are generally nonrefundable except where a refund is required by applicable law or expressly promised in connection with the applicable offer.
Nothing in these Terms limits any nonwaivable refund, cancellation, or consumer right provided by applicable law.

21. Chargebacks and Payment Disputes
If you believe that a charge is incorrect, you may contact us at info@migrainebodyreset.com so that we can investigate the matter.
Nothing in these Terms requires you to contact us before exercising a payment-dispute right that applicable law or your payment provider gives you.
Knowingly initiating a fraudulent or materially false payment dispute is prohibited.
If payment for a Service is reversed, refunded, or subject to an unresolved chargeback, we may suspend access to the Service associated with that payment where reasonably appropriate.
Nothing in this section limits any rights provided by applicable law or by your bank, card issuer, or payment provider.

22. Promotions and Discount Codes
From time to time, we may offer discounts, promotional prices, coupons, or other promotional offers.
Promotions may be subject to eligibility requirements, expiration dates, product restrictions, and other conditions disclosed with the applicable offer.
Unless expressly stated otherwise:
promotional offers have no cash value;
discounts cannot be exchanged for cash;
discounts may not be combined; and
a promotional price applies only to the purchase identified in the offer.
We may refuse or cancel promotional use involving fraud, unauthorized resale, manipulation, or an obvious technical or pricing error.
Specific written promotional terms control if they differ from this section.

23. Third-Party Platforms, Services, and Links
The Website and Services may use or link to third-party:
course platforms;
video-hosting providers;
payment processors;
email providers;
communications platforms;
analytics services;
software integrations;
websites; or
other technology providers.
Independent third parties are responsible for their own services, terms, privacy practices, and security practices.
We do not control and cannot guarantee the uninterrupted availability of independent third-party services.
A link to or integration with a third party does not necessarily constitute an endorsement of that third party.

24. Communications With Support
You may communicate with us through info@migrainebodyreset.com or through other support methods that we make available.
Support communications are intended for administrative, technical, educational, or customer-service matters.
Support communications are not medical consultations and are not appropriate for medical emergencies.
If you voluntarily provide information concerning your health, symptoms, migraine experiences, medications, or other personal matters, our handling of personal information is governed by our Privacy Policy and applicable law.
You should avoid sending information that is unnecessary for us to answer your question.

25. Privacy and Cookies
Our collection, use, storage, disclosure, and protection of personal information are governed by our Privacy Policy, available at:
https://www.iubenda.com/privacy-policy/46428170
Our use of cookies and similar tracking technologies is described in our Cookie Policy, available at:
https://www.iubenda.com/privacy-policy/46428170/cookie-policy
These Terms do not replace the Privacy Policy or Cookie Policy.
Acceptance of these Terms does not constitute blanket consent to every form of collection, use, profiling, disclosure, or processing of personal or health-related information.
Where applicable law requires separate consent, authorization, or an opportunity to opt out of a particular data practice, such rights and choices will be provided separately as required by applicable law.

26. Availability of the Website
We use reasonable efforts to keep the Website and Services available, but uninterrupted access cannot be guaranteed.
Access may occasionally be interrupted because of:
maintenance;
updates;
hosting failures;
internet disruptions;
cybersecurity incidents;
third-party platform failures;
technical problems; or
circumstances beyond our reasonable control.
Temporary interruption does not automatically entitle a user to a refund, provided that the purchased Service remains substantially available during the promised access period and subject to rights that cannot lawfully be waived.

27. Suspension and Termination
We may suspend or terminate your account or access if we reasonably believe that:
you materially violated these Terms;
you shared or redistributed protected content without authorization;
you shared account credentials in violation of these Terms;
your account creates a material security risk;
a payment was fraudulent or unauthorized;
your use of the Services is unlawful;
suspension is required by law; or
continued access would materially harm the Company, its systems, or other users.
Where reasonably practicable, we may provide notice and an opportunity to correct a curable violation.
If paid access is terminated because of your material breach, you may not be entitled to a refund except where required by applicable law.
If we permanently terminate paid access without a breach by you and do not provide substantially equivalent access during the guaranteed access period, we will provide an appropriate alternative, credit, or refund consistent with Section 12 and applicable law.

28. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
EXCEPT FOR EXPRESS PROMISES MADE IN THESE TERMS OR IN THE APPLICABLE PURCHASE OFFER, THE COMPANY DISCLAIMS ALL WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, SUITABLE FOR EVERY PERSON, OR CAPABLE OF PRODUCING ANY PARTICULAR HEALTH, WELLNESS, OR OTHER RESULT.
Some jurisdictions do not allow exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the maximum extent permitted by law.

29. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUMA PROPERTIES, LLC, MIGRAINE NATURAL SOLUTION, MIGRAINE BODY RESET, AND THEIR RESPECTIVE OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, OR DATA, ARISING OUT OF OR RELATED TO THE WEBSITE OR SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PAID SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO THE COMPANY FOR THE SERVICE GIVING RISE TO THE CLAIM.
These limitations apply regardless of the legal theory asserted, to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability to the extent applicable law prohibits limitation for fraud, willful misconduct, gross negligence, death, personal injury, or other legally nonwaivable claims.

30. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Company and its owners, officers, employees, instructors, contractors, and agents from third-party claims, liabilities, damages, and reasonable costs arising directly from:
your unlawful misuse of the Services;
your unauthorized copying, sale, or redistribution of Company materials;
your infringement of another person's intellectual-property rights through your misuse of the Services; or
your material violation of these Terms.
You are not required to indemnify the Company for the Company's own conduct to the extent such an obligation is prohibited by applicable law.

31. Equitable Relief for Intellectual-Property Violations
Unauthorized copying, sale, publication, or distribution of paid course materials may cause harm that cannot always be adequately remedied by monetary damages alone.
Where permitted by applicable law, the Company may seek injunctive or other equitable relief to prevent actual or threatened infringement or unauthorized distribution, in addition to other remedies available under applicable law.

32. Force Majeure
The Company will not be responsible for a delay or failure to perform caused by circumstances reasonably beyond its control, including:
natural disasters;
widespread internet or utility failures;
failures of critical third-party infrastructure;
war;
terrorism;
civil disturbance;
government action;
epidemics or similar public-health events;
labor disruptions; or
other comparable events outside the Company's reasonable control.
This section does not eliminate any obligation or consumer right that applicable law does not permit the Company to exclude.

33. Electronic Communications
You agree that we may provide contractual notices, purchase confirmations, receipts, account information, course-access information, refund communications, and other transactional communications electronically, including by email.
You are responsible for maintaining a current email address associated with your account.
Transactional communications are separate from promotional marketing communications. Nothing in these Terms is intended to constitute consent to marketing where separate consent is required by applicable law.

34. Changes to These Terms
We may update these Terms from time to time.
The current version will be made available on the Website and will display an updated “Last Updated” date.
Material changes generally apply prospectively.
Where required by law, we will provide reasonable notice of material changes affecting an ongoing paid Service.
We will not use a change to these Terms to retroactively eliminate a material right or guarantee expressly provided as part of a completed purchase where doing so would violate applicable law.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

35. International Users
The Services are primarily directed to customers in the United States, although they may be accessible and purchased from other countries.
Access to the Website from another country does not mean that the Company represents that every aspect of the Website or Services complies with the laws of that jurisdiction.
Users outside the United States are responsible for complying with applicable local laws.
Nothing in these Terms is intended to waive mandatory consumer rights that applicable law does not permit a consumer to waive.
If the Company later specifically targets consumers in additional jurisdictions, additional local terms or policies may apply.

36. Governing Law
These Terms and any dispute arising out of or relating to the Website, Services, or a purchase are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
This choice of law does not deprive a consumer of any nonwaivable protection that applicable law requires to remain available.

37. Disputes, Courts, and Small Claims
These Terms do not require mandatory arbitration.
Subject to applicable law and except for eligible small-claims matters, any legal action arising out of or relating to these Terms, the Website, the Services, or a purchase shall be brought exclusively in a state court located in the State of Wyoming or in the applicable federal court located in Wyoming, and the parties consent to the personal jurisdiction of those courts.
Either party may bring an eligible claim in a small claims court of competent jurisdiction where the requirements of that court are satisfied.
Nothing in this section prevents either party from seeking temporary or injunctive relief where such relief is legally available and appropriate.

38. Assignment
You may not assign or transfer your rights under these Terms without our prior written consent.
We may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of substantially all relevant assets, transfer of the applicable business, or to an affiliate or successor that assumes the relevant obligations.

39. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed.
The remaining provisions will continue in effect.

40. Waiver
Our failure or delay in enforcing a provision of these Terms does not constitute a waiver of that provision or of our right to enforce it in the future.
A waiver on one occasion does not constitute a waiver on another occasion.

41. Entire Agreement
These Terms, together with:
the material terms presented on the applicable sales page;
the purchase terms shown at checkout;
any applicable refund guarantee; and
any product-specific terms expressly presented to you,
constitute the agreement between you and the Company concerning the applicable Service.
Nothing in this section eliminates an express written guarantee or material promise made to you as part of the applicable purchase offer.
Our Privacy Policy separately governs our handling of personal information.
